TERMS OF SERVICE (EULA)

1. Introduction

These Terms of Service ("Terms") govern the use of the Terra mobile application ("App"). The App is developed and operated by the development team ("we", "us").

You and the Developer acknowledge that these Terms are entered into solely between you and the Developer, that Apple is not a party to this agreement, and that the Developer is solely responsible for the App and its content. These Terms may not contain usage rules that conflict with the Apple Media Services Terms of Use as of the effective date (you acknowledge that you have had the opportunity to review those terms).

By downloading, installing, or using the App, you are deemed to have accepted these Terms. If you do not accept the Terms, please do not use the App.

2. Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple-branded devices that you own or control, in accordance with the rules set forth in the Apple Media Services Terms of Use. The App may be accessed and used by accounts associated with the purchaser through Family Sharing or volume purchasing.

3. Maintenance and Support

The Developer is solely responsible for all maintenance and support services related to the App. You and the Developer acknowledge that Apple has no obligation to provide any maintenance or support services related to the App.

4. Warranty

The Developer is solely responsible for all product warranties (express or implied by law) to the extent permitted by applicable law. If the App fails to conform to any applicable warranty, the End User may notify Apple, and Apple will refund the purchase price of the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and all other claims, losses, liabilities, damages, costs, or expenses arising from non-conformity with any warranty are solely the Developer's responsibility.

5. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is solely responsible for addressing any claims relating to the App or the End User's possession and/or use of the App, including product liability claims; claims that the App fails to conform to applicable legal or regulatory requirements; and claims arising from consumer protection, privacy, or similar legislation. These Terms may not limit the Developer's liability to the End User beyond what applicable law permits.

6. Intellectual Property Infringement

In the event of any claim that the App or the End User's possession and use of the App infringes a third party's intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance

By using the App, you represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Agreements

When using the App, you must comply with applicable third-party agreement terms (for example, not violating your wireless data service agreement).

9. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon the End User's acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the End User as a third-party beneficiary.

10. Service Description

The Terra app is a mobile application developed to inform users during earthquakes and disasters, assist with preparedness, provide rapid access in emergencies, enable location sharing, and display assembly areas.

Earthquake data is sourced from AFAD (Disaster and Emergency Management Presidency), Kandilli Observatory and Earthquake Research Institute (Boğaziçi University), and USGS (United States Geological Survey).

This app is not affiliated with any official institution (AFAD, Kandilli, etc.) and is for informational purposes only. Terra is not an official earthquake warning system.

11. Technical Requirements

For the App to function properly:

Your device's operating system must be up to date.

Required permissions for earthquake notifications, location services, and emergency features must be granted.

Because earthquake data is obtained from third-party sources, the app requires an internet connection.

12. User Account

12.1 Account Creation: You may need to create an account to use the App. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account information. You are responsible for all activity that occurs under your account.

12.2 Age Limit: You must be at least 18 years old to use the App. If you are under 18, you may use it with parental or guardian consent.

13. Rules of Use

When using the App, you agree to refrain from the following behaviors:

Sharing illegal, harmful, threatening, harassing, abusive, or obscene content

Infringing others' intellectual property rights

Sending viruses, trojans, or malicious code

Attempting to bypass the App's security features

Collecting content using automated systems or bots

Impersonating other users

Sending spam or unsolicited advertising

14. Location Services

The App uses your location information to show you the nearest assembly areas and to share your location in emergencies. Your location data:

Is collected only with your consent

Is stored in encrypted form

May be shared with contacts you designate in emergencies

15. Emergency Services

The Terra app is an information and preparedness tool. In emergencies, you must always call official emergency numbers (112). The App does not replace official emergency services and should not cause delays in life-threatening situations.

16. Content and Intellectual Property

16.1 App Content: The App and its content (text, graphics, logos, images, software, design, database) are owned by the development team and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, distribute, modify, or use App content for commercial purposes without permission. The "Terra" brand and logo are the intellectual property of the development team.

16.2 User Content: You are fully responsible for content you upload, share, or submit to the App (profile photo, address information, messages, etc.). By sharing your content, you grant us a worldwide, royalty-free, sublicensable, transferable license.

16.3 Third-Party Content: The App may contain content obtained from third-party sources such as earthquake data. Such content is subject to the intellectual property rights of the relevant third parties.

17. Free and Paid Services

17.1 Terra Premium Subscription: The Terra app offers both free and Terra Premium (paid) features.

Subscription title: Terra Premium

Subscription periods: Monthly plan (1 month), Annual plan (12 months), Family plan (monthly or 12 months)

Price: Subscription prices are displayed in the app at the time of purchase. Prices may vary by country and region. Prices may change without prior notice.

Free trial: A free trial period may be offered during certain promotions. At the end of the trial period, the subscription automatically converts to a paid period. You will be charged unless you cancel.

Payments: Made through the Apple App Store or Google Play Store.

17.2 Auto-Renewal: Premium subscriptions renew automatically. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current period.

To cancel your subscription, you can do so from your device's settings menu or within the app.

Cancellation takes effect at the end of the current subscription period.

Canceled subscriptions remain active until the end of the paid period.

17.3 Refund Policy: Refund requests are managed through the platform where the purchase was made (Apple App Store or Google Play Store).

Apple App Store: You may request a refund within 14 days of the initial purchase.

Google Play Store: Refund policies are subject to Google's general terms.

Refund requests must be made directly through the relevant platform.

Users who cannot use the service due to technical issues may contact info@terraapp.io.

17.4 Advertising: In-app ads may be shown on the free plan. Terra Premium subscription offers an ad-free experience. For detailed information about ad delivery and related data processing practices, see our Privacy Policy.

17.5 Subscription Changes: You may switch from a monthly to an annual subscription (or vice versa). Plan changes take effect at the end of the current subscription period. Price increases take effect at the end of the current subscription period and are communicated in advance.

18. Account Termination and Service Suspension

18.1 Termination by User: You may delete your account at any time. Account deletion is irreversible and all your data is permanently deleted. If you have a Premium subscription, we recommend canceling it before deleting your account.

18.2 Termination by Development Team: The development team may suspend or terminate your account without prior notice in the following cases: violation of these Terms of Service, engaging in illegal activities, compromising app security, or prolonged inactivity (2 years). In such cases, proportional refunds may be provided to Premium users.

19. Disclaimer

The App is provided "as is" and "as available." The development team does not guarantee that the service will be uninterrupted or error-free, the accuracy or reliability of content, and is not liable for damages arising from use of the App.

20. Limitation of Liability

To the maximum extent permitted by law, the development team shall not be liable for any indirect, incidental, special, or consequential damages under any circumstances.

21. Changes

The development team reserves the right to modify these Terms at any time. Significant changes will be communicated through the app. If you continue to use the app after changes, you are deemed to have accepted the new Terms.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Disputes arising from or related to these Terms will first be attempted to be resolved through negotiations between the parties. Disputes that cannot be resolved through negotiations are subject to the jurisdiction of the courts and enforcement offices of Istanbul.
